HIS occupation is listed as "charlatan" on court documents and now doctor David Kaye, who allegedly bought his PhD over the internet for $249.95, stands to lose his multi-million-dollar property empire and his Mercedes-Benz.
The NSW Crime Commission has won a Supreme Court fight for restraining orders over the homes and offices owned by the convicted conman, whose real name is Ali Davut Sarikaya.
Kaye, who has treated police officers and other public servants referred through WorkCover NSW, runs the Sydney Trauma Clinic, Parramatta Trauma Clinic and the Melbourne Trauma Clinic. But he is alleged to have no qualifications as a psychologist.
The court orders block him from disposing of his properties in Sydney, Parramatta, Eden and Melbourne pending the outcome of criminal charges which allege a $100,000 fraud against the New Zealand Inland Revenue Department.
It is the latest stage of a legal saga that began when Kaye was arrested at Sydney Airport as he attempted to board a flight to New Zealand last year. He also faces investigations by the NSW Medical Board, the Psychologists Registration Board and Work Cover.
The court heard 20 fraud charges against Kaye, alleging among other things that he defrauded the NSW Official Visitors Program, had been dropped. He was appointed as an official visitor - allowing him to visit patients in mental facilities - by the then-health minister John Hatzistergos, despite not being a medical doctor. But the Supreme Court heard those charges had been withdrawn because there was no requirement to be a doctor in order to be appointed under the OVP scheme.
Justice David Davies said last week that the new charges of defrauding the New Zealand Inland Revenue still involve the "identity of, qualifications of, and work carried on by" Kaye. He said it was alleged that Kaye was convicted of fraud in Victoria and declared bankrupt.
The court heard Kaye used several variations of his real name and David Kaye, although he had not changed it officially by deed poll.
Since 1997, he had been establishing himself as Dr David Kaye and "claims to have a PhD but inquiries have indicated this was purchased via the internet from an organisation in Minnesota, USA", the judge said. He has a Bachelor of Arts from Monash University and a part-completed graduate diploma in counselling from RMIT but had recorded his occupation as psychologist on the electoral roll and on passenger departure cards at Sydney Airport, the judge said.
The new charges involve invoices Kaye allegedly submitted in New Zealand for seven years of staff support and counselling services that were never provided. Kaye challenged the allegations put to the court by the NSW Crime Commission, but Justice Davies found that there were "reasonable grounds" for the suspicions.
Kaye owns a Milsons Point apartment, two homes in Eden and offices in Sydney, Parramatta and Melbourne from where he runs his clinics.

I worked with David Kaye between 1997 and 2000 and got to know him when he was the Haed and National Manager of the Bensons Group Injury Management Service. He is a compassionate, ethical and honorable man.

I have known David Kaye since 1997 when he was the Head and National Manager of The Bensons Group Injury Management Service. I later became one of the contracted psychologists at his practice in Melbourne.
I also willingly supported him and will continue to support him. David is a man of great integrity, has a wealth of theoretical knowledge and 25 years of experience as a competent mental health professional/Counsellor. David is one of the most trustworthy, honorable and compassionate professionals I have dealt with and I have written letters of support attesting to this.
I am not aware of a single client of his that has come forward with a complaint about the counselling they have received from him or his staff.
Can I suggest that you checked the facts. David is a clinical member of his national professional body, has been found NOT to have falsely represented himself as a psychologist after a thorough investigation by the NSW Psychologists Board and made significant contributions to this community.

Are any of you aware of how many times David Sarikaya has been accused of assualt against women? You would be horrified!
I experienced the violence and the psychopathic behaviour of David Sarikaya indirectly through a good friend who was his partner.
The only thing more frightening than Sarikaya's propensity for physical violence when feeling threatened was his capacity for emotional violence. The best words I can think of to describe him would be personality disorder and delusional psychotic. It is actually quite remarkable that he has not killed anyone yet.
He is incapable of feeling empathy for others and will stop at nothing to establish credibility, especially professional credibility. He lies routinely and does not recognise any authority. On top of all this he is also a sexual predator.
He was born in Turkey and had an horrific childhood which has no doubt contributed greatly to his enormous dysfunction. He will never change and it is important that he is properly exposed and prevented from hurting others.

My name is Maree. I am David Sarikaya's former partner. I am horrified at the attacks on David not to say the reckless nature with which the attacks have been done to vilify him and demonize him when he has faced and defeated 5 sets of 83 false charges brought against him, the last concluding on 19 January 2011.
David has been a great source of help for a lot of people. he is a professional with over 25 years of counselling experience and has saved hundreds of lives.
I find this blog sick and appalling.
Look, David and I parted ways about 10 years ago and I would not normally get involved in this but this website is truly disturbing, especially given that the posts are anonymous and the object of the demonization, in this case David have no way of defending himself. This was an attempt to criminalise voluntary work that David Kaye did for 2 years and all charges brought against him by an officer- against whom David had filed a formal complaint with the NSW Police Integrity Commission on 5 July 2009 for attempting to extort $30K from him on 3 July 2009- were withdrawn due to lack of evidence. David Kaye has done voluntary work in various private and government positions for over 23 years. Civic duty cannot be criminalised to perpetuate personal smear campaigns by public office holders who have a duty to protect the public.
However, since 25 June 2009 and more so since 4 August 2009, a number of unethical, incompetent and disgraceful wanna be journalists such as Yoni Bashan, Lisa Muxworthy, Boel Erricksson and Brendan Hills have published false information about David Kaye and they should be ashamed of themselves to call themselves a Journalist which they are not.
