Injured Worker Case 2

Woman injured knee at work.

This woman hits her knee at work and injures the patella (kneecap).
She spends months off work and has two separate surgeries on it and the repairs were unsuccessful.

She has been told by all specialists she has seen, that she needs a complete new knee.
That was 5 years ago!

She is still hobbling around on her knee and as she has been left for 5 years her back and hip has now also gone due to the way she has walked for last 5 years.

Why has she been left for 5 years with an unrepaired knee?

Workcover know her knee will not get better so they have now decided to refuse her medical and alike expenses for her doctors appointments and medications and physio Why do this? what does it prove? they need to replace her knee, so why haven't they? Its been 5 years?

They have also told her to get a new job when she wants to return to her previous employment of 16 years as she has the right to. She has been told that she can go back to work but, in another job/place, but wont tell her where she can get that job and who would hire her with her totaled knee in the first place.

Why would workcover put other employer at risk by telling this woman to find another job?
And who would hire her? This is ridiculous and is just passing the buck to another employer and this peice of legislation is idiotic and needs to be changed. This worker has the right to return to work and in her previous job as the legislation states, so why are workcover trying to force her and other injured workers to find alternative employment? Injuring yourself at work should'nt mean you loose your job?

This woman has worked for the same company for 16 years, so why should she have to find another job? Workcover should just fix her knee so she can get back to work like she expected to!

Workcover are not insuring a return to work is commenced and continued for these injured workers. Employers should not have the right to reject an injured worker from returning to work yet they are, and workcover are allowing it! So whom are they here to protect them, us or all?
